1. Overview

This website and online store are operated by A&G Jewelry LLC (“A&G Jewelry,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, online store, content, products, communications, and related services (collectively, the “Services”).

By visiting the website, creating an account, submitting information, or purchasing through the Services, you agree to these Terms and to the policies referenced in them, including our Refund and Returns Policy, Shipping Policy, and Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and lawful use

You must be at least the age of legal majority in your state of residence, or use the Services with the involvement and consent of a parent or legal guardian. You may use the Services only for lawful personal or business purposes and in compliance with applicable law.

You may not use the Services to commit fraud, violate another person’s rights, transmit malicious code, interfere with website security, scrape protected content, submit false information, or make unauthorized purchases.

3. Account and order information

You agree to provide current, complete, and accurate information, including billing, shipping, contact, and payment information. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.

Contact us immediately if you believe an account or payment method has been used without authorization. We may suspend access, request verification, or cancel an order when we reasonably suspect fraud, unauthorized activity, policy abuse, or a security risk.

4. Products and product presentation

We make reasonable efforts to display jewelry accurately. Photographs may be enlarged to show detail. Colors may vary due to lighting, photography, screen settings, and finish. Unless expressly stated as guaranteed, product weights, measurements, stone counts, carat weights, and dimensions are approximate and may vary slightly by item, size, or production.

Natural and manufactured materials may show minor variations. Such normal variations do not necessarily constitute a defect. Product descriptions, availability, and specifications may be updated without notice.

5. Prices, taxes, and errors

Prices are shown in U.S. dollars unless otherwise stated. Taxes, shipping, insurance, sizing, engraving, appraisal, rush, financing, and other applicable charges may be added during checkout or confirmed before the order is finalized.

We may correct pricing, description, inventory, or calculation errors. If an error affects an order, we may contact you for approval of the corrected terms or cancel the affected item and return the applicable amount to the original payment method. We are not obligated to honor a price that is clearly erroneous to the extent permitted by law.

6. Orders and acceptance

Submitting an order is an offer to purchase. An automated acknowledgment does not necessarily mean that we have accepted the order. We may verify information and accept, decline, limit, or cancel an order for reasons including product availability, pricing or description errors, inability to verify information, suspected fraud, payment issues, shipping restrictions, resale activity, or policy abuse.

If we cancel an order after collecting payment, we will return the applicable canceled amount as required by law. We may limit quantities per customer, household, account, payment method, or address.

7. Payment

You represent that you are authorized to use the payment method provided and authorize A&G Jewelry and its payment providers to charge all amounts associated with the order. Orders may not be processed until payment and verification are complete.

Payment services may be provided by Shopify or other third parties. Their separate terms and privacy practices may apply.

8. Financing

Financing may be offered by an independent third-party provider. A&G Jewelry does not determine every eligibility decision, interest rate, fee, payment schedule, credit-reporting practice, or financing term. The financing agreement is between the customer and the provider, subject to the provider’s disclosures and terms.

A return, exchange, cancellation, or dispute with A&G Jewelry does not automatically cancel a financing agreement. Any approved adjustment will be processed according to applicable law and the provider’s procedures.

9. Layaway and special payment arrangements

Layaway is subject to a separate written agreement that states the deposit, balance, payment schedule, deadline, cancellation terms, and treatment of missed payments. A layaway item is not released until the required balance is paid and all conditions are met.

Unless the written layaway agreement or applicable law states otherwise, layaway deposits and payments are nonrefundable, and layaway merchandise is final sale. If a separate written agreement conflicts with these Terms concerning that layaway purchase, the specific written agreement controls.

10. Custom, sized, engraved, and special-order merchandise

You are responsible for confirming spelling, initials, dates, measurements, ring size, metal, color, karat, stone selections, design details, and other specifications before approving custom work.

Custom, personalized, sized, engraved, modified, sourced, and made-to-order items become final sale when work or sourcing begins. Production times are estimates and may be affected by material availability, design changes, verification, or events outside our reasonable control.

11. Shipping and delivery

Shipping is governed by our Shipping Policy. Processing time and carrier transit time are separate. Delivery estimates are not guarantees.

Title and risk allocation will be determined by applicable law and any valid carrier or insurance requirements. Nothing in these Terms eliminates rights that cannot legally be waived.

You must provide accurate shipping information and cooperate with reasonable identity, address, carrier, insurance, and fraud-verification procedures.

12. Returns, exchanges, cancellations, and defects

Returns, exchanges, cancellations, incorrect items, damage, and defects are governed by our Refund and Returns Policy. All sales are final, with limited exchanges available only for eligible items requested within the stated period.

Nothing in these Terms limits a remedy that must be provided under applicable law.

13. Jewelry care, repairs, and normal wear

Jewelry requires appropriate care and periodic maintenance. Scratches, dents, tarnish, stretched links, loose stones, worn prongs, clasp wear, finish changes, and damage from impact, chemicals, moisture, heat, improper storage, or ordinary use are not automatically manufacturing defects.

Do not permit an unauthorized third party to repair, resize, polish, plate, engrave, or modify an item that is the subject of a claim. Unauthorized work may prevent us from determining the original condition or cause of damage.

Any warranty or repair service must be stated separately in writing. No lifetime warranty or free-maintenance promise applies unless expressly included with the specific item.

14. Promotions, discount codes, and gift cards

Promotions and discount codes are subject to their stated dates, exclusions, and conditions. Unless stated otherwise, offers cannot be combined, applied retroactively, redeemed for cash, or used for taxes, shipping, insurance, services, layaway deposits, or gift cards.

Gift cards are subject to applicable law and any terms disclosed when purchased or issued.

15. Reviews, messages, and submitted content

If you submit a review, photograph, video, comment, testimonial, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights.

You grant A&G Jewelry a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display submitted content for operating, promoting, and improving the Services, unless prohibited by law. We may remove content that is unlawful, deceptive, abusive, irrelevant, or infringing, but we have no obligation to publish every submission.

16. Intellectual property

The Services and their original content—including the A&G Jewelry name, logo, slogan, design, text, photographs, videos, graphics, and arrangement—are owned by or licensed to A&G Jewelry LLC and protected by applicable law.

These Terms grant only a limited, revocable, nonexclusive right to use the Services for their intended purpose. They do not transfer intellectual-property ownership. You may not reproduce, distribute, modify, sell, scrape, frame, reverse engineer, or commercially exploit protected content without prior written permission.

17. Third-party tools, links, and services

The Services may contain third-party tools, applications, links, payment options, social features, financing, and carrier services. We do not control all third-party operations and do not guarantee that every third-party service will remain available, uninterrupted, or error-free.

Your use of a third-party service may be governed by separate terms and privacy practices. Review them before use.

18. Prohibited conduct

You may not:

• Use the Services for unlawful, fraudulent, or abusive activity;

• Misrepresent your identity, authority, address, payment information, or order purpose;

• Attempt an unauthorized charge, return, exchange, discount, claim, or chargeback;

• Introduce malware or interfere with the operation or security of the Services;

• Collect personal information about others without authorization;

• Copy, scrape, or exploit protected content or product data;

• Circumvent purchase limits or security controls; or

• Use the Services in a manner that infringes rights or harms A&G Jewelry, its customers, or another person.

We may restrict or terminate access and take appropriate action when prohibited conduct is suspected.

19. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the website will always be uninterrupted, secure, or error-free.

Products are covered only by warranties expressly provided in writing with the applicable product. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

20. Limitation of liability

To the fullest extent permitted by law, A&G Jewelry LLC and its owners, officers, employees, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or opportunity arising from or related to the Services or products.

To the fullest extent permitted by law, our aggregate liability arising from a claim will not exceed the amount you paid to A&G Jewelry for the product or order giving rise to that claim.

These limitations do not apply where liability cannot legally be limited, including any rights or remedies that applicable consumer law does not allow the parties to waive.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless A&G Jewelry LLC and its owners, officers, employees, agents, contractors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person’s rights.

22. Privacy

Our collection and use of personal information are governed by our Privacy Policy. Third-party providers may process information under their own privacy notices.

23. Electronic communications

You consent to receive transactional communications electronically at the contact information you provide, including order, payment, verification, shipping, security, policy, and customer-service notices. Marketing messages are subject to separate consent and applicable opt-out rights.

24. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, and by applicable federal law.

Unless applicable law requires otherwise, any court proceeding arising from these Terms or the Services must be brought in a state or federal court with jurisdiction in Duval County, Florida. You and A&G Jewelry consent to that court’s personal jurisdiction and venue.

25. Severability and waiver

If a provision of these Terms is found unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

26. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, sale, reorganization, or transfer of the business or its assets, subject to applicable law.

27. Entire agreement

These Terms and the policies and transaction-specific agreements incorporated into them constitute the agreement between you and A&G Jewelry concerning the Services. A specific written custom-order, layaway, financing, or sales agreement controls over these general Terms only to the extent of a direct conflict concerning that transaction.

28. Changes to these Terms

We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless applicable law permits or requires otherwise. Your continued use of the Services after an update constitutes acceptance of the revised Terms.

29. Termination

We may suspend or terminate access to the Services when reasonably necessary to address a violation, fraud, security risk, legal requirement, or harm to A&G Jewelry or another person. Provisions that by their nature should survive termination will remain in effect.
